I own a leasehold flat managed by a managing agent. A prospective tenant wishes to keep one cat.

The managing agent has granted consent, but only on the basis that: “The cat must be a house cat and must not be allowed to wander the communal areas at any given time. Should the cat be reported to be seen in the communal areas at any given time this consent will be revoked.”

My concern is practical enforceability. The development is surrounded by residential properties and there are other cats regularly seen in and around the grounds. It would be difficult to establish whether a cat seen in a communal area was actually the tenant’s cat or one belonging to neighbouring properties.

Under the Renters’ Rights Act, landlords and managing agents are expected to consider pet requests reasonably and not rely on blanket restrictions. Tenants can request permission to keep a pet and consent should not be unreasonably withheld.

Has anyone encountered similar conditions? Would a consent term that could effectively be revoked based on an unverified sighting of a cat be regarded as reasonable, particularly where there is no reliable way of identifying whose cat it is?

I’d be interested in views from both landlords and leasehold specialists.

Thanks,

Amanda
