EPFO PF claim delay: Consumer commission orders 6% interest for 35-day delay
A consumer commission has ordered the Employees’ Provident Fund Organisation (EPFO) to pay 6% annual interest to a retired employee to compensate for a 35-day delay in settling his provident fund claim worth ₹14.06 lakh.
The Mumbai Suburban District Consumer Disputes Redressal Commission categorically held EPFO guilty of ‘deficiency in service’ because the provident fund institution failed to settle the claim within the stipulated 20-day period under the EPF Scheme, 1952, news agency PTI reported.
Why the consumer court held EPFO responsible
The complainant, a former employee of Fleet Maritime Services (India) Pvt Ltd, stated that he submitted a complete PF claim on October 19 2016. EPFO, however, argued that the required joint declaration was missing and that the claim was returned on November 7 for the same reason. According to the EPFO, it received the complete documents on December 2 and eventually settled the claim on December 14, 2016.
The commission categorically rejected this defence, noting that EPFO failed to produce any written rejection letter, clarification or deficiency communication to comprehensively establish that the original claim was incomplete.
“On the evidence available on record, the Opposite Party has failed to satisfactorily establish that the claim was incomplete on 19.10.2016,” the commission said. It further held that EPFO should have processed the claim within the prescribed period, i.e., the timeline and that its failure amounted to a clear ‘deficiency in service’.

The commission ordered the EPFO to pay 6% per per annum interest on ₹14,06.272 for the 35-day delay from November 9 to December 13 2016. To ensure compliance, EPFO has been granted 45 days to comply with the order.
